Our Terms and Conditions are designed to ensure a mutual understanding and agreement between Siesta Advisor (hereafter referred to as "we," "us," or "our") and you, the participant (hereafter referred to as "you," "your," or "client"), to facilitate a seamless, enjoyable, and safe experience. Please read the following terms carefully before making a booking. By proceeding with a reservation, you acknowledge that you have read, understood, and agreed to be bound by these terms.

1. Booking and Payment Procedures

1.1. Booking Confirmation: All bookings are subject to availability and only confirmed upon receipt of full payment and issuance of a confirmation email from Siesta Advisor.

1.2. Payment Method: Payments can be made via credit/debit card, bank transfer, or any other payment method specified on our official website or booking platforms. Details of payment methods will be provided during the booking process.

1.3. Pricing and Taxes: All prices are listed in the currency specified on our website and include any applicable taxes and fees unless stated otherwise.

2. Cancellation Policy

Siesta Advisor aims to provide flexibility for cancellations while maintaining fairness to all clients. Refunds and vouchers are processed according to the following timeframes.

1.1 Refunds & Vouchers

We understand that plans can change, and we aim to provide a fair and flexible refund policy that balances the needs of our clients with the operational commitments of our team. For cancellations made at least one week (7 days) prior to the scheduled activity, clients are entitled to a 100% refund of the booking cost.

  • Cancelations Made at Least One Week (7 Days) Before the Activity
    1. Customers are eligible for a 75% refund of the total booking cost - Alternatively, customers may opt for a voucher retaining 100% of the value of the booking, which can be redeemed for a future activity (subject to availability).
  • Cancellation Made Within 48 to 7 Days Before the Activity
    1. Customers are eligible for a 50% refund of the total booking cost - Alternatively, customers may opt for a voucher retaining 100% of the value of the booking, which can be redeemed for a future activity (subject to availability).
  • Cancellation Made Within 24 Hours of the Activity
    1. No refund will be issued for cancellations within this time frame - Customers may still opt for a voucher retaining 100% of the value of the booking, which can be redeemed for a future activity (subject to availability).

1.2 Notification Requirements

All cancellations must be communicated in written form, either via email to our official contact address or through the booking platform used for the reservation. Refunds are processed promptly but may take 7-10 business days to appear in the customer's account, depending on financial institution processing times.

1.3 Exceptions to Policy

We understand that unexpected events such as sudden illness, family emergencies, or other significant circumstances may necessitate cancellations. In such cases, we will review exceptions to our cancellation policy on a case-by-case basis. Customers must provide supporting documentation (e.g., medical notes, death certificates) for their claims. Our goal is to accommodate these situations as fairly as possible while considering the interests of all parties.

3. Weather and Safety Considerations

3.1. Adverse Weather Conditions: We prioritize safety and may cancel activities in the event of hazardous weather conditions. Customers will be notified as soon as possible and offered a reschedule or refund.

3.2. Safety Measures: Participants must comply with all safety instructions and guidelines provided by Siesta Advisor staff and guides. Failure to do so may result in exclusion from the activity without a refund.

4. Participant Requirements

4.1. Health and Fitness: Participants must ensure they are in good health and have the appropriate level of fitness for the activity chosen. You may be required to complete a health questionnaire before participating.

4.2. Age Restrictions: Some activities have minimum age requirements for safety reasons. Please check specific activity details for age restrictions.

4.3. Special Requirements: Please inform us of any special needs, medical conditions, or dietary restrictions at the time of booking so accommodations can be considered.

5. Conduct and Behavior Policy

5.1. Expected Behavior: All participants are expected to act respectfully towards staff, fellow participants, and the environment. Disruptive or disrespectful behavior may lead to removal from the activity.

5.2. Alcohol and Drugs: Participants under the influence of alcohol or drugs will not be permitted to partake in activities and will not be entitled to a refund.

6. Privacy and Data Protection

6.1. Collection of Information: We collect necessary personal information for booking and safety purposes. This may include your name, contact information, payment details, and any special requirements.

6.2. Use of Information: Your information will only be used for the purpose of fulfilling your booking and will not be shared with third parties without your consent, except as required by law.

7. Liability and Insurance

7.1. Liability Waiver: All participants are required to sign a liability waiver before participating, acknowledging the inherent risks associated with the activity and agreeing to release Siesta Advisor from liability for personal injury, property damage, or loss.

7.2. Insurance: Participants are strongly recommended to obtain their own travel insurance covering personal injury, medical expenses, and loss of property.

8. Intellectual Property Rights

8.1. Copyright: The content on Siesta Advisor's website and promotional materials, including text, graphics, logos, and images, is protected by copyright and belongs to Siesta Advisor or its licensors.

9. Amendments to Terms & Conditions

9.1. Right to Amend: We reserve the right to update or modify these Terms & Conditions at any time without prior notice. The most current version will be available on our website and will supersede any previous versions.

10. Governing Law and Jurisdiction

10.1. Legal Compliance: These Terms & Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Siesta Advisor operates. Any disputes arising under or in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

Siesta Advisor es una empresa familiar con más de una década de experiencia dedicada a ofrecer experiencias turísticas y de aventura en la costa de Jávea, especializada en actividades como kayak, snorkel y turismo activo al aire libre. Nuestro compromiso se centra en proporcionar un servicio seguro, profesional y cercano, garantizando vivencias únicas y de alta calidad a nuestros clientes, respaldadas por un equipo experto y apasionado y por numerosos reconocimientos internacionales que avalan nuestra dedicación y excelencia.

Para respaldar y avalar el trabajo que hemos realizado de manera satisfactoria durante el trayecto de la empresa, se ha decidido certificar a Siesta Advisor SL, bajo los requisitos de las normas internacionales UNE-EN-ISO 9001:2015 de Sistemas de Gestión de Calidad y UNE-EN-ISO 14001:2015 Sistemas de Gestión de Medio Ambiente.

Esta Política de Calidad y Medio Ambiente es revisada para su continua adecuación al menos una vez al año, a la vez que los objetivos y metas de Calidad, constituyendo un marco de referencia para el establecimiento y revisión de los mismos.
